Halle Berry was supposed to be starring in the Broadway play, The Mountaintop, late this summer. The play was expected to premiere right at the end of summer in September. Berry has been taking a break from her movies, while raising her three-year-old daughter, Nahla. But, with Nahla getting a little older, Berry was getting back to work.

Ever since December of 2010, Halle Berry has been involved in a custody battle with Nahla's father, Gabriel Aubry. The couple began dating in 2006, but they split up in April 2010. In 2008, Halle Berry gave birth to her daughter, Nahla. Berry was hoping the custody battle would not get in the way of her career.

Having been out of commission since 2007, Halle Berry has been hoping to land a comeback. However, the ongoing battle with Aubry has forced Berry to step out of her role in The Mountaintop. Despite all she had been hoping for, Halle Berry is forced to step away from her career, once again. However, this is not the first time she has had to back out of a role because of legal issues. Berry had to back out of New Year's Eve, because she was not allowed to take Nahla out of New York.

But, with New Year's Eve, Nahla was able to regain her role. This will not be the case with The Mountaintop.
